Our Trademark Opposition service focuses on defending your trademark application. Once your trademark is approved by the United States Patent and Trademark Office examiner (attorney) your trademark moves to publication. Publication in short is when the United States Patent and Trademark Office notifies the public you intend to register a trademark. Parties that feel they may be harmed by you registering a trademark are given a 30 day period of time to oppose your trademark.
If you receive a Notice of Opposition you must respond. Failure to respond will result in your trademark becoming abandoned. The filing of an opposition is the start of a trademark litigation before the United States Trademark Trial and Appeal Board (TTAB).
If you receive notification of opposition that your trademark is being opposed by another common law right or trademark owner please contact our office to schedule a legal consult with a Licensed Trademark Attorney.
