A Statement of Use is a specimen and sworn declaration that your proposed trademark is currently in use in commerce. If you file a 1 (b) intent to use application you are required to submit a statement of use form to the United States Patent and Trademark Office. Failure to submit a statement of use timely will result in your trademark becoming abandoned.
To be considered timely, a Statement of Use must be filed within six months of the issuance date of the Notice of Allowance (NOA), or within a previously granted extension of time to file a Statement of Use.
